Takfīr, Al-Ḥākimiyyah and the Methodological Foundations of Declaring Disbelief: An Analytical Study in Light of Classical Islamic Legal Theory

The declaration of takfīr, pronouncing a professed Muslim to be outside Islam, has become central to the ideology of contemporary militant movements. Its most influential justification is a reading of al-ḥākimiyyah, divine sovereignty, grounded in Q 5:44. This article argues that the classical restrictions on takfīr are not discretionary cautions appended to Islamic law but consequences of how that law weighs evidence. Drawing on the Hanafi uṣūl al-fiqh tradition of al-Bazdawī, al-Sarakhsī, and al-Nasafī’s al-Manār with its commentaries, it reconstructs the classification of scriptural evidence along two independent axes, certainty of transmission (thubūt) and certainty of indication (dalālah). It shows that the tradition distinguished the authority of a proof from its certainty. A proof may bind action without producing the knowledge on which a judgment of disbelief could rest, so that denial of a farḍ constitutes kufr while denial of a wājib does not. From this framework the article derives the evidentiary threshold for takfīr and shows that the classical conditions and impediments governing its application to individuals are applications of the same epistemic logic. Applying the resulting fourfold test to Q 5:44, it finds the verse definitive in transmission but probable in its indication that non-application of revealed law is as such major disbelief. What it establishes definitively is that rejection of the authority of revelation is disbelief. The contemporary takfīrī argument transfers the certainty of the latter proposition to the former, collapsing the classical distinctions between the definitive and the probable, juhūd and taʾwīl, sin and disbelief, and general and specific takfīr.
